TERMS AND CONDITIONS

Effective Date: November 13, 2025

1. SCOPE OF SERVICE Testament Travel (hereinafter “the Company,” “we,” “us,” or “our”) acts strictly as a sales agent for any cruise line, airline, hotel, tour operator, or other service provider named in your itinerary (“Suppliers”). We are an independent affiliate of OutsideAgents.com. We provide professional travel consultation and booking services, but we do not own, manage, or operate any of the travel services being purchased.

2. AGENT FOR SUPPLIERS By booking with us, you acknowledge that the Company is not liable for the acts, errors, omissions, warranties, breaches, or negligence of any Supplier. All bookings are subject to the terms and conditions, including cancellation policies, of the respective Suppliers. In the event of a Supplier’s bankruptcy or cessation of operations, your recourse is directly against the Supplier and not Testament Travel.

3. PRICING AND PAYMENTS

  • Quotes: All price quotes are subject to availability and can change until a deposit is paid and a confirmation is issued.

  • Deposits: Deposits are required to secure bookings. Many deposits are non-refundable based on Supplier policies.

  • Currency: All prices are in U.S. Dollars unless otherwise specified.

  • Credit Card Authorization: By providing your payment information, you authorize Testament Travel or our Suppliers to charge your card for the specified amount.

  • Third-Party Processing: Testament Travel does not directly process or “touch” your payment funds. All payments are handled via secure third-party websites or direct Supplier systems.

  • Data Storage: For your protection, no credit card information is stored on www.testamenttravel.com.

4. CANCELLATIONS AND REFUNDS Cancellations must be submitted in writing to Deb@oacruise.com. Please be aware:

  • Most travel bookings carry significant cancellation penalties. These penalties are strictly determined and enforced by the individual Suppliers (e.g., the cruise line or tour operator). Testament Travel has no control over Supplier refund policies or penalty amounts.

  • Testament Travel may charge a professional service fee for processing cancellations or changes, which is separate from any Supplier penalties.

  • No Agency Cancellation Fees: While Testament Travel does not charge an additional fee for processing a cancellation, we have no authority to waive or reduce the penalties imposed by the Suppliers.
  • Refunds: Any refunds due will be processed by the Supplier according to their specific timeline and terms. Testament Travel does not hold client funds and cannot issue direct refunds.

  • No-shows are non-refundable.

5. TRAVEL DOCUMENTS AND IDENTIFICATION It is the passenger’s sole responsibility to ensure they possess valid travel documents, including:

  • Passports (valid for at least 6 months beyond the return date).

  • Visas and transit visas (where required).

  • Health certificates or proof of vaccination. Testament Travel is not responsible for any passenger being denied boarding or entry into a country due to improper documentation.

6. TRAVEL INSURANCE Testament Travel strongly recommends the purchase of comprehensive travel insurance. Travel insurance can protect your investment in the event of medical emergencies, trip interruptions, weather-related delays, or Supplier defaults. If you choose to decline travel insurance, you acknowledge that you are personally responsible for any financial losses associated with your travel.

7. LIMITATION OF LIABILITY Testament Travel shall not be held liable for any injury, loss, claim, damage, or any direct/indirect damages arising out of:

  • Supplier delays, cancellations, or overbookings.

  • Acts of God, weather, or civil unrest.

  • Personal injury or property damage during travel. Our maximum liability to you, if any, shall not exceed the total amount of professional fees paid to Testament Travel for the specific booking in question.

8. HEALTH AND SAFETY Travelers assume all risks regarding health and safety while traveling. This includes, but is not limited to, exposure to infectious diseases or changing local laws. It is your responsibility to check the U.S. State Department and CDC websites for current travel advisories.

9. GOVERNING LAW These Terms and Conditions shall be governed by the laws of the State where Testament Travel is registered. Any disputes arising from this agreement shall be settled through binding arbitration or in a court of competent jurisdiction within that State.

10. ACCEPTANCE OF TERMS Payment of a deposit or a signed booking professional service agreement shall be deemed as your consent and acceptance of these Terms and Conditions and our Privacy Policy.
